Update on FY 2010 H-1B Count

Reflective of the recessionary business environment, the annual H-1B limit of 65,000 new H-1Bs has yet to be reached.

However, the 20,000 H-1Bs set aside for candidates who hold an advanced US degree, were exhausted very quickly (within the first two weeks of April). Candidates who hold advanced US degrees may continue to file against the regular cap of 65,000 since they qualify against either cap.

As of May 22, 2009, approximately 45,700 H-1B cap-subject petitions had been received. To illustrate the "pace" of filing, below are the previous updates provided by USCIS:

As of May 18, 2009:
45,500 regular H-1B cap-subject petitions.

As of May 11, 2009:
45,000 regular H-1B cap-subject petitions.

As of May 4, 2009:
45,000 regular H-1B cap-subject petitions.

As of April 27, 2009:
45,000 regular H-1B cap-subject petitions.

As of April 20, 2009:
44,000 regular H-1B cap-subject petitions.

As of April 13, 2009:
43,000 regular H-1B cap-subject petitions.

As of April 9, 2009:
42,000 regular H-1B cap-subject petitions.
